severely impacted by the traffic. we will rely coverage as it begins to pick up. that should happen around 9:00 a.m.. reporting from san rafael, will tran, kron 4 news. if >> other stories we are falling, the gun used by a man who got into a shootout with san francisco police has now been recovered. officers say a baby resident this led them to the weapon. ballistic tests confirmed that it is a match for the gun that 19 year-old kenneth harding used and then he ended up killing themselves with. harding was killed during a shootout with police on july 16th. it looks as if he shot and killed himself. >> to washington, we are now just four days away, tuesday is the deadline to raise the debt ceiling or the u.s. government will not be able to borrow money to pay its bills. today, house republicans are trying for a third day to pass a debt ceiling bill that has almost no chance of surviving the senate even if it passes the house. house speaker john boehner
suffered a stinging setback when a group of conservative republicans backed out from voting for his plan. baker had to postpone the vote can't while he tried to win support -- john boehner had to postpone the vote while he tried to win back support. some house republicans are speaking out as to why they are not voting for the plan. >> i cannot support this plan. i would love to be able to support john dinner. >> we want to assure that we never get here again. i want to support something that makes sure that we never did hear again. >> its debt is the problem, raising the debt limit by $2.4 billion, i do not see how that is a solution. >> if republicans continue to fail to pass a bill in the house, president obama and the senate democrats will have extensive leverage to pass a bill in the senate and practically dear the house to reject the bill which would then send the nation into default. >> president barack obama is

>> here is the president. >> an increasingly urgent effort to avoid default and reduce our deficit. right now the house of representatives is still trying to pass a bill that the majority of republicans and democrats in the senate have already said it will not vote for. it is a plan that would force us to relive this crisis in just a few short months holding our economy captives to washington politics once again. in other words it does not solve the problem. it has no chance of becoming law. what is clear now is said any solution to avoid defaults must be bipartisan. it must have the support of both parties that were sent here to represent the american people, not just one faction. it will have to have the support of both the house and the senate. there are multiple ways to resolve this problem. santer read, a democrat has introduced a plan in the
senate that contains cuts agreed upon by both parties, senator mcconnell offered a solution that could get us through this. and there are plenty of modifications that we can make high their plan to get them passed through both the house and senate plan would allow me to sign them into law. i want a plan by consigned by tuesday, that would get support from both houses. this is not a situation where the parties are miles apart, we are in rough agreement about how much spending can be cut responsibly as a first step to reducing our deficit. so what the next step is a debate in the coming months on tax reform and in time to reform. i am ready and willing to have that debate. if we need to put in
place some kind of reform mechanism, and i am willing to do that if it is done a positive way. we need a compromise by tuesday's of the country will have the ability to pay its bills on tuesday, those that include monthly social security checks, veterans' benefits and government contracts that we have signed with thousands of businesses. keep in mind, if we do not do that, if we do not come to an agreement we could lose our aaa credit rating. " not because we did not have the capacity to pay bills, we do, but because we did not have a triple a political system to match. her " a lower credit rating would result potentially in a tax increase on everyone in the form of higher interest rates on mortgages, car loans
and credit cards. hurricanes, earthquakes, tornadoes, there are a lot of things we cannot predict. this is not one of those crisis. the power to solve this is in our hands. on a day when we have been reminded how fragile the economy already is, this is one burn that can lift ourselves. it can and with a simple vote a bill that democrats and republicans have been taking for decades. a vote that the leaders in congress have taken for decades. it is not a vote that allows congress to spend more money. raising the debt ceiling simply gives our country the ability to pay the bills or that congress has already racked up. i want to emphasize that. price the debt ceiling does not determine how
much more we can spend, it simply authorizes us to pay the bills that we already have. it gives the united states the ability to keep its word i ask the american people to make their voice heard in this debate. the response was overwhelming. please, to all of the american people, keep it up. if you want to see a bipartisan compromise, a bill that can pass in both houses of congress and that i can sign, which your members of congress know. make a phone call, send an e-mail, tweet, keep the pressure on washington and we can get past this. for my part, our administration the time for putting party first is over. it's time for compromise on behalf of the american people is now. horace i am confident we

bill in the house. they had to shell the vote was 9 because they did not have enough republicans voting yes to get it passed. even if it does pass in the house, it is going to be tabled in the senate. in the senate, harry reid announced that he is working on a plan that would cut 2.5 trillion in the deficit over a decade saying that it is likely the last chance to save the nation from the fall. a vote in the senate could come as early as sunday. >> right now president obama is live announcing a deal to boost fuel economy. the deal will double fuel economy standards to nearly a 55 mi. per gallon year 2025. here he is live in washington as we speak. moments ago, the president addressed the nation on debt negotiations. he says there are multiple ways to resolve the debt crisis but it has to be bipartisan and it has to happen fast. take a listen. >> keep in mind, if we do not do that, if we do not come to an
agreement, we could lose our country's triple a credit rating. not because we did not have the capacity to pay our bills, we do, but because we did not have a truly political system to match our aaa credit rating. make no mistake, for those who say they impose tax increases on anyone, a lower credit rating would result a tax increase on everyone in the form of higher interest rates on their mortgages, car loans, credit cards, and that is inexcusable. >> the president also urged democrats and republicans in the senate to come together on a plan that could pass the house and that he could sign. they have until tuesday. it >> they're having a tough time. more on what is happening in the house. speaker john bakers suffered a stinging setback for a second consecutive day. he had to postpone a vote last night. the house was in session until 7:00 p.m. as john maynard try to get the votes necessary to get
his bill passed. he was not able to do it. they had to end the session many republicans in the house say that john plan's did not have enough cuts. one house republican remains hopeful. >> when i predict will be done today, for the third time, send a plan that raises the debt ceiling in a responsible way. the senate has not done it, the white house has not done it. i respectfully disagree, no one wants to default. i have not met a sole that once a deep fault, no do we want a downgrade which is coming if we do not bend to his spending issue in this country. >> that is the plan that is going on in the public and controlled house. in the new democratic controlled senate, harry reid has invited his republican counterpart, leader

vote. we waited until late last night and now we are told that some time later today speaker banner may have rounded up enough republican votes to pass his plan. it is clearly not bipartisan. when you look closely it is not right for america. in negotiating hawks, the most extreme voices in his caucus, he is now moving to positions that are almost indescribable. the latest report that we have, in order to win the last holdouts on the tea party, he had to agree as to a significant and historic change, not enough that they are willing to hold our economy hostage with the debt ceiling, it is not enough that we stop the workings of this government on so many issues that we should be working on, now the speaker has brought in the requirement to extend the debt ceiling. this is the most outrageous suggestion i have
heard. to think that those of us have allowed this to become a bargaining chips prepared, to say that we cannot move the economy in this country forward and the nation forward without changing our constitution as a requirement room, i wish there robert byrd was still here. he would be on the floor with its constitution in hand and reminding people about the utility that we should show when it comes to this great document. approach this in a responsible and bipartisan way by starting with read suggestion coming together at a bipartisan basis. he is offering his measure and an olive branch or to work together for a bipartisan solution that is sensible and timely. i hope that senator mcconnell will join him. we do not want to put

powell cable car has been taken out of service. >> we are joined by ivan gold, our legal analysts. we're finding out that an important decision is coming out from the state supreme court regarding same-sex marriage and that will be heard just after labor day. it is not above the issue itself, it is about is the backers of proposition 8 can defend it in court. >> the proponents have the legal authority to bring this lawsuit, the sponsors of this initiative. remember, it was ruled unconstitutional. >> in that loss to the defendants were then governor as schwarzenegger and jerry brown. they were sued over proposition 8. it was defeated and declared unconstitutional. they went back and said carl we do not want to appeal. click >> it is a political hot button. remember, the proponents of wanted to ban it same-sex marriage. arnold schwarzenegger and jerry brown
favor same-sex marriage. they did not want to appeal the ban. the sponsors want to go into court directly and the court is saying, you guys are not the attorney general, you are not the governor, what are you doing? he did not have standing in that they are saying yes we do and the judge is saying, show me. under state law, only the governor and attorney general to appeal this. the court is saying, we are a federal court, this is a state court to issue. been one guidance from the supreme court. the argument on intersex is going to be, do they have legal standing? the thing is, this could open a pandora's box. this is going to potentially to the authority away from the governor and the attorney general. i am not sure the courts will want to do that or if state law will allow that. this could get appealed and go to the california supreme court. oddly enough, this case may not stand for same-sex marriage,
this case might be new case law for standing up proponents of these initiatives. ironically, that is where this could be going. >> this could go to the u.s. supreme court, but not on the issue of same-sex marriage, but the issue of if they have standing to fight? >> if the court rules that they do, then it would go back and argue the substance of the case, but you are right, this could go to the u.s. supreme court on the standing issue. there is a lot of litigation that could come forward. >> if they cannot defend, if the proponents cannot defend same- sex marriage, will same-sex marriage be allowed to happen? >> same-sex marriage within the constitutional. if there is no standing, the merits of the case is over, the federal court decision will stand up because the attorney general and governor will not appeal. perhaps in the future, another governor or attorney-general they want to appeal. that would be a different story or another initiative down the road in a different political time. with different judges, governors or
attorney general's and maybe different result. for now of the court throws out based on lack of standing, the ball game is over. >> it is unconstitutional, it stands, can you put another ballot measure forward even though it is unconstitutional? if >> absolutely. a different measure, it could be worded differently. remember, these are judges can make these legal rulings. maybe a different judge in a different political climate or timing disagree with the previous judge and may find it constitutional. that is what constitutional law is always changing. the laws change, the ballot initiatives change. judge's role differently, it could be the same issue but the world differently because they disagree. most u.s. supreme court decisions are close rock. reasonable minds can differ. >> this is something will probably be talking about even three years for now. a >> it will be in the courts for a long time. >> i've been gold, to give for joining us. we will be right back as the kron 4 morning news
